- INTRODUCTION
Please read the following Terms and Conditions carefully. By using Steward Remit and its related services, the customer acknowledges that the customer has read and understood the Terms and Conditions and that the customer accepts and will be bound by them, as they may be modified by Steward Bank Limited (the Bank) from time to time. The customer authorizes the Bank to disclose personal information of the customer in line with the dictates of the law, to request a credit report on the customer and/or to obtain information from other third parties and financial institutions regarding the customer in line with the customer’s use of Steward Remit. If the customer does not agree to the Terms and Conditions of use, the customer may not use this Intrabound remittance facility. - DEFINITIONS
For the purpose of these Terms of Use, the following words shall bear the following meanings:
2.1 ‘Bank’ means Steward Bank Zimbabwe Limited, a banking institution duly registered and licensed in terms of the laws of Zimbabwe, having its principal place of business at 79 Oliver Tambo Avenue, Corner 7th Street, Harare, Zimbabwe.
2.2 “Steward Remit” means the Intrabound remittance service operated by Steward Bank which provides users in Zimbabwe with the ability to initiate the transfer of foreign currency to designated recipients within Zimbabwe.
2.3 “Transaction Fee” means the fee paid by a Sender when creating an order for a Remittance Transaction.
2.4 “Pay-Out Partner” means an entity appointed Steward Bank to pay out a Remittance Transaction as per Sender’s payment instructions when initiating a Remittance Transaction. Where reference is made to the Bank under these Terms and Conditions, it shall also include the Pay-Out Partner.
2.5 “Receive Amount” means the amount designated by the Sender when initiating the Remittance Transaction minus the Transaction Fee.
2.6 “Receiving Currency/ Remittance” means the foreign currency paid out to the beneficiary under the service.
2.7 “Recipient” means the individual who is designated by the Sender as the beneficiary of the Remittance Transaction and to whom the Remittance is disbursed by a designated Pay-Out Partner.
2.8 “Remittance Transaction” means the transmission of funds via Steward Remit service to a designated Recipient pursuant to an instruction received from a Sender.
2.9 “Sender” means the individual who initiates a Remittance Transaction for the benefit of the Recipient.
2.10 “RBZ” means the Reserve Bank of Zimbabwe, the central bank of Zimbabwe and all divisions under it such as the Financial Intelligence Unit (FIU).
2.11 “You”, “Customer” and “Your” refer to the individual reading these Terms and Conditions who is or will become a user of the Steward Remit Service. - LEGAL AND COMPLIANCE
3.1 This remittance service is governed by Zimbabwean law and any arising dispute pursuant to these Terms and Conditions will be determined by the courts in Harare, Zimbabwe.
3.2 The Bank, its affiliates and payment intermediaries are subject to the Zimbabwean laws, orders, requests and guidelines and also to the respective policies and procedures adopted by Bank, its affiliates and payment intermediaries relating to, without limitation: anti-money laundering (AML); counter-terrorism financing (CFT); security, diplomatic, trade, financial, economic and other embargoes and sanctions; court orders; investigations; taxes; transaction review and monitoring; and reporting requirements.
3.3 In seeking to comply with such regulations and policies especially relating to AML/CFT, the Bank, its affiliates and/or payment intermediaries may suspend, reject, restrain, deduct, turn report or block the remittance transaction without any notice to the customer.
3.4 The Customer shall bear the risk of any delay and losses relating to any and all actions or forbearance from action. The Bank, its affiliates and payment intermediaries may not be permitted to disclose information relating to actions taken in respect of regulations or their policies, immediately or at any time. - REMITTANCE SERVICE REQUIREMENTS
4.1 Persons who are 18 years or older are eligible to send/ receive money through the Steward Remit service and are required to submit personal information for registration, verification, credit reporting and disclosure to the Bank’s Regulators.
4.2 By using the service, you represent and warrant that you are 18 years or older and of legal age to form a binding agreement with Steward Bank Limited. If you submit a Remittance Transaction, you are requesting that we process the Remittance Transaction on your behalf, an offer which we may accept, suspend, limit, report or reject at our sole discretion without any notice.
4.3 The Bank shall seek to execute the remittance transaction on the business day that Bank receives the remittance application, if received prior to the applicable cut-off time at Bank’s service location. The remittance may take longer than one business day to execute. You hereby indemnify the Bank in respect of any claims, demands or actions made against the Bank or losses or damages suffered by yourself or the recipient due to delays in processing remittance transactions.
4.4 The Bank/ will issue you with documentation or receipt detailing the pricing and delivery time applicable to your Remittance Transaction as applicable.
4.5 You have the right to dispute errors in your Remittance Transaction. You can register cancellation for a full refund within 30 (thirty) minutes of payment if the money has not been paid out or deposited. If you think there is an error contact the Bank within 90 (ninety) days.
4.6 For security reasons, Steward Bank recommends that you only send money through the Steward Remit service to people you know personally. You must not use the Steward Remit Service to send money to strangers, for example, sellers of goods and/or services whether private or retail.
4.7 If, at any time, Steward has reason to believe that the information or documentation provided is false or altered in any way, your transactions will be flagged and reported to the RBZ as a suspicious transaction.
4.8 In the event that your designated Recipient is unable to receive disbursement of the Remittance because incorrect information was provided for the Recipient when the Remittance Transaction was created, you are obliged to contact the Bank to correct any errors in the information provided. - CANCELLATIONS AND REFUNDS
5.1 If you instruct the Bank to process a Remittance Transaction and then subsequently request that the Remittance Transaction be stopped or reversed, the Bank will first need to confirm whether the Pay-Out Partner has disbursed the Remittance to the Recipient before the transaction can be stopped or reversed.
5.2 If the Bank confirms that payment has not been made to the Recipient, the Remittance Transaction will be cancelled and Steward Bank/ Steward Bank’s Affiliates will refund the amount of the Remittance, less Transaction Service Fee, to you. A refund will be in the same currency deposited by the customer for the intrabound remittance services.
5.3 All refunds shall be available within 7 (seven) calendar days of the date on which the refund is received from the Pay-Out Partner. For further information, please send an email to the customer service department at customerservice@stewardbank.co.zw. - LIMITS
A user of the Intrabound Remittance will be limited to sending a maximum amount of:
6.1 USD 500 (five hundred United States Dollars) per day; for Steward Bank Account Holders
6.2 USD 250 (two hundred and fifty United States Dollars) per day; for non-Steward Bank Account Customers
6.3 USD 2,000 (two thousand United States Dollars) per month; for Steward Bank Account Holders and
6.4 USD 1,000 (one thousand United States Dollars) per month; for non-Steward Bank Account Holders. - FEES
For use of the Intrabound Remittance Service:
7.1 In consideration of your use of the Intrabound Remittance Service, you agree to pay a service Fee per Remittance Transaction executed through the service.
7.2 Payment of the Transactional Service Fee is due at the time that you instruct the Bank to process your Remittance Transaction.
7.3 The Transaction Service Fee is subject to review and can be changed at any time at the sole discretion of Steward Bank Limited. - COLLECTION OF INFORMATION
8.1 The Sender and the Recipient agree to provide the KYC documentation required in order to access the service, including but not limited to proof of identity, proof of income and proof of residence.
8.2 You consent to Steward Bank/Steward Bank Affiliate processing your personal information for the purposes of providing the Intrabound remittances service, including for the verification of your identity and source of funds, and for regulatory purposes. You consent to provide any additional information as may be requested by Steward Bank or its affiliates within the specified period of time.
8.3 You also consent to the use of such personal information for communicating with you, and for statutory, accounting and archival purposes.
8.4 You acknowledge that you have read and agreed to be bound by Steward Bank’s Privacy Policy.
8.5 By completing and signing this form you consent to the collection and use of Personal Information as indicated below;
8.5.1 to execute money transfer transaction;
8.5.2 to contact you in response to a specific enquiry;
8.5.3 to send you promotional emails or messages to call you about products, services, offers and other things the Bank thinks might be relevant to you;
8.5.4 for the Bank’s and its affiliates own internal records and
8.5.5 to improve the products and services the Bank provides to its clients. - NO WARRANTY
9.1 Steward Bank/Steward Bank Affiliate, officers, directors, agents and employees do not guarantee continuous, uninterrupted or secure access to the Intrabound Remittance Service, and operation of the Remittance Service may be interfered with by numerous factors outside of Steward Bank/Steward Bank Affiliate’s control.
9.2 The Remittance Service is provided “as is” and as and when available and, to the extent permissible by law, Steward Bank/Steward Bank Affiliate ‘s excludes all implied warranties, conditions or other terms, whether implied by statute or otherwise, including without limitation, any terms as to skill and care or timeliness of performance. - LIMITATION OF LIABILITY
10.1 In no event shall the Bank, its service providers, or their respective subsidiaries, officers, agents, partners, or employees be liable for any direct losses or damages unless the loss was caused by fraud, gross negligence or willful misconduct on the Bank’s part. In these circumstances, the liability of the Bank shall not exceed the value of the transaction amount and the transaction fees. In no event shall the Bank be liable for any indirect, incidental, special, consequential or exemplary damages whatsoever.
10.2 The Bank shall not be liable for any direct, indirect or consequential loss or damage sustained by the customer arising due to any delay in communicating or performance of any instructions or transactions due to any reason arising on account of circumstances not attributable to the Bank or beyond control of the Bank such as, reasons of failure of operational systems, any kind of technical or system failures, natural calamity, floods, fire and other natural disasters, legal restraints, faults in the telecommunication network or network failure, software or hardware error, labour problem, strike or any other reason beyond the control of the Bank. - INDEMNITY
11.1 You agree to defend, indemnify and hold harmless Steward Bank/Steward Bank Affiliate and their respective officers, directors, employees, contractors, agents, licensors and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) resulting from your violation of these Terms of Use or your use of the Intrabound Remittance Service other than as expressly authorized in these Terms of Use or your negligence, fraud or willful misconduct.
11.2 You agree to fully reimburse Steward Bank/Steward Bank Affiliate in respect of all losses, costs, actions, claims, and liabilities incurred by Steward Bank/Steward Bank Affiliate as a result of any breach or non-observance by you of these Terms of Use or any inaccuracies in the data submitted by you to Steward Bank/Steward Bank Affiliate. - COMMENTS AND COMPLAINTS

13.1 Entire Agreement: These Terms of Use, Steward Bank Privacy Policy (accessible on the Bank’s website), and your receipt for any Remittance Transactions constitute the sole and entire agreement between you and Steward Bank with respect to the Intrabound Remittance Service.
13.2 When you effect Remittance Transactions through the Intrabound Remittance Service any and all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Intrabound Remittance Services are superseded.
13.3 Changes to Terms of Use; Steward Bank may revise and update these Terms of Use from time to time in its sole discretion by posting a revised version on the Steward Bank’s website. Except as otherwise required by law, the revised version will be effective at the time of posting to the Steward Bank’s website. The customer accepts that posting a change to the terms of use on the website is sufficient notice to the customer, and by utilizing the service the customer accepts to be bound thereto.
